CELLPHONEGUYS sends transactional messages (repair estimates, appointment confirmations, ready-for-pickup notifications, status updates) and promotional messages (special offers, service announcements) via SMS.

To stop receiving messages, reply STOP to any text message. Message and data rates may apply. Check with your carrier for details. Carriers are not liable for delayed or undelivered messages. 1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you") and CELLPHONEGUYS, operating as "Cellphone Guys" ("we," "us," or "our"), governing your use of our website, SMS messaging, repair services, phone sales, and related offerings. By submitting a form, opting in to SMS, or visiting our shop, you agree to these Terms.

2. Service Description

Cellphone Guys provides:

Phone, tablet, and electronics repair services

New and pre-owned phone sales

Prepaid wireless plan setup and activation

Device trade in and buyback

Related accessories and services

Services are delivered at our shop at 12501 Burbank Blvd Suite #1, Valley Village, CA 91607, or coordinated through SMS, chat, phone, and our website.

3. Repair Services

3.1 Estimates

Repair estimates provided through our SMS, chat, or website are ballpark ranges based on the information you provide. Exact pricing is confirmed once a technician inspects the device in person. Diagnostic services for complex issues (water damage, motherboard, software issues, device not turning on) are provided at no charge.

3.2 Warranty

We offer a 90 day warranty on parts and labor for completed repairs. The warranty covers defects in the replacement parts and workmanship. It does not cover new physical damage, water damage, or issues unrelated to the original repair. Warranty service requires the original repair receipt.

3.3 Unclaimed Devices

Devices not picked up within 60 days of repair completion may be considered abandoned. We will make reasonable attempts to contact you before disposing of or reselling abandoned devices.

3.4 Backup

You are responsible for backing up your data before repair. While we take care to preserve device contents, we are not liable for data loss during the repair process.

4. Phone Sales

4.1 Pricing and Availability

Phone inventory and pricing change daily based on stock. Prices quoted via SMS, chat, or by phone are subject to in person confirmation. All phone sales are completed in person at our shop.

4.2 Device Condition

We disclose the condition of all devices sold (new, pre-owned Grade A, pre-owned Grade B, etc.). All devices are tested and warrantied as described at point of sale.

4.3 Returns

Phone sales may be eligible for return within 7 days of purchase, subject to inspection. Custom orders, opened accessories, and devices showing physical or liquid damage after purchase are not eligible for return.

5. Customer Responsibilities

As a customer, you agree to:

Provide accurate information when requesting estimates or making purchases

Be the rightful owner of any device you bring in for repair, sale, or trade

Pick up devices within 60 days of repair completion

Maintain a valid form of payment for invoiced services

Use our SMS messaging service responsibly and not for any unlawful purpose

6. SMS Communications

By providing your phone number and checking the SMS consent box, you agree to receive transactional and promotional text messages from Cellphone Guys. Message frequency varies based on appointment and repair activity. You may opt out at any time by replying STOP. Message and data rates may apply.

7. AI Chat Disclosure

Inquiries received through our website chat widget and SMS may be handled by an AI assistant (Isabella). The AI may provide ballpark estimates, schedule appointments, and answer common questions. Complex or sensitive issues are routed to a member of our team. By interacting with our chat or messaging channels, you acknowledge that responses may be generated by an AI system.

8. Data Ownership and Usage

Information you provide is used to deliver the services you request and is handled in accordance with our Privacy Policy. We may use anonymized and aggregated data to improve our operations.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising under these Terms shall not exceed the total amount paid by you to us for the specific service giving rise to the claim. We shall not be liable for indirect, incidental, consequential, special, or punitive damages, including data loss, lost business opportunities, or device value beyond repair cost.

10. Prohibited Uses

You may not use our services or SMS messaging to:

Submit fraudulent estimate requests or service inquiries

Send or solicit illegal, harassing, or deceptive content

Impersonate any person or business

Bring in devices that are not lawfully yours

Resell, scrape, or misuse our messaging service in any way

11. Termination

We reserve the right to refuse service, decline repairs, or terminate SMS communications at our discretion if you violate these Terms or engage in prohibited uses.

12. Dispute Resolution

Any disputes arising under these Terms shall first be addressed through good faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association. These Terms are governed by the laws of the State of California.

13. Modifications

We may revise these Terms at any time. The revised version will be indicated by the Effective Date at the top. Continued use of our services or SMS messaging after changes constitutes acceptance.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cellphone Guys regarding the use of our services and SMS communications, and supersede all prior understandings.
